“New car smell” defense used in Colorado hit & run case involving cyclist

A Denver-based financial planner is using a unique defense to explain why he hit a bicyclist from behind near Vail, Colorado, last summer and didn't stop:

The new car smell of his 2010 Mercedes sedan made it happen.

Attorneys for Martin Erzinger say in court documents that their client suffers from sleep apnea. They maintain that he had fallen asleep behind the wheel and drove onto the shoulder where he hit Stephen Milo, a liver transplant anesthesiologist from New York.

An accident reconstructionist, John Koziol of Koziol Forensic hired by the defense, claims that the month-old car was emitting new car fumes and that may have been a contributing factor. Quoted in the SummitDaily, Koziol wrote ….

Some cycling routes closed by “Pineapple Express”

A break in the weather Monday afternoon enabled me to get out for a short bike ride to one of my favorite haunts, May Valley Road.

Although my career in newspapers ended 15 years ago, I still feel a need to survey the damage from severe weather.

There was still plenty of evidence of flooding and small slides, even a day after the torrential downpours that swept through Western Washington.

Updated: Lance Armstrong had a golden touch in 2009

We already know that Lance Armstrong's return to the 2009 Tour de France helped boost the viewership on the Versus cable network — as 41% more people watched the race last year than in 2008.

Now Bloomberg reports that he also helped fatten the wallet of the Amaury Sport Organization, owner of Le Tour and other cycling events around the world.

 [Update: Dec. 23, 2010 — That assertion has been questioned by John Wilcockson of VeloNews, who reports that Amaury revenues climbed in 2009 due to the return of the Dakar Rally, a motor sports race. In summary, Wilcockson found that Amaury's revenues dropped in 2008 when the Africa-based Dakar Rally was cancelled due to terrorist threats. Rails-to-Trails bicyclists deliver petition to AAA

Bicyclists representing the Rails-to-Trails Conservancy delivered a petition with more than 51,000 signatures to the American Automobile Association headquarters in Heathrow, Florida, Monday morning.

The petition asks that AAA stop its opposition to using the federal Highway Trust Fund to pay for trails and other bicycling programs. Those programs amount to about 1.5% of the surface transportation funding, according to the non-profit.

About 25 cyclists joined the procession from the OutSpoke'N Bike Shop in Lake Mary, Florida, to the AAA offices located on the Seminole-Wekiva Trail …

Police urge women to use caution in Seattle parks and trails

After the attacks on four women in Seattle parks and trails the past few weeks, police are urging women to take measures to ensure their safety.

All of the attacks have occurred after dark against women who were jogging or running alone. The locations — Colman Park, Seward Park and Mt. Baker tunnel area — are all along the western shore of Lake Washington.

Although none of the assaults involved women on bicycles, a Nov. 16 attack occurred near the east entrance of the Mount Baker tunnel, an area used by many bicycle commuters.

When a half dozen bicyclists were pulled off their bikes and mugged in the Mount Baker tunnel area during a period in 2008 and 2009, police and bike advocates urged that bicyclists ride in groups through the area. Riding with a pal or in a group…
